Right to Privacy – The Right to be Forgotten.

In a society increasingly dominated by social media and online personal profiles, we are frequently asked to assist clients in the removal of negative historic press articles.

These remain easily accessible to third parties with a simple search using one of the common search engines.

This information can be anything from details of previous criminal charges and / or convictions, to publicity about personal relationships if one party is a celebrity or in the public eye.

Such adverse press can adversely affect a client personally or their business by causing e.g.  refusal of funding applications, loss of investors or simply loss of individual employment opportunities.

 

We are able to advise on the right to have personal information removed for privacy reasons and where appropriate to also advise on the law pertaining to spent convictions.

A company operating a search engine such as Google or Bing is responsible for the processing of this personal data in the context of determining the results shown by the search as well as handling delisting requests.

The search engine controller is required to balance the privacy rights of the individual concerned with the interest of the general public, in having access to the information, as well as the right of others to distribute the information.

This may result in their refusal to remove certain information about financial scams, professional malpractice, criminal convictions, or public conduct of government officials.

Each delisting request to a search engine controller is considered on its own individual facts. As such we take a bespoke approach to our client’s specific needs.
